Eminent Domain

Route 61

Attorneys at Williamson, Friedberg & Jones, LLC have extensive experience in Litigation and Real Estate, which makes the firm particularly well suited for representation in Eminent Domain proceedings, such as the “Deer Lake North” project in Schuylkill County.

In the Deer Lake project, PennDot is currently in the process of acquiring land in both Deer Lake and West Brunswick Township to widen State Route 61 and construct a new roadway for the southbound lanes of Route 61. “Deer Lake North” is expected to begin in Spring of 2010. The section of SR61 that will be particularly affected is between Brick Hill Road and State Route 895.

In order to perform this project, PennDot is about to commence Eminent Domain (condemnation) proceedings in which the Commonwealth of Pennsylvania intends to seize several dozen properties.

These eminent domain proceedings will affect many homes and businesses along State Route 61. Some individuals and businesses may only face condemnation of a portion of their land. However, numerous property owners, including a number of prominent area businesses, will lose their entire property and face the decision of either ceasing operations or relocating.

In addition to property owners, commercial and residential tenants of properties along State Route 61 will also face various expenses and inconveniences from this project which are often reimbursable. Additionally, many buildings along the affected section of State Route 61 are rented. Therefore, when these buildings are seized, the residential and commercial tenants who occupy these buildings will also be displaced.

It is extremely important that all land owners as well as all tenants of properties involved in the PennDot eminent domain proceedings seek experienced legal counsel who can protect their rights and represent them in the procedures used to compensate them for their loss of property. Accordingly, Williamson, Friedberg & Jones, LLC attorneys are available to represent those who are affected by these eminent domain proceedings.
