Nearly all owners and occupants, including tenants, of real estate which is seized in PennDot eminent domain proceedings are eligible for compensation. The amount of compensation and the items which are compensable varies depending on the manner in which the property was used (residential or commercial) as well as the relationship between the property and the party occupying the property (owner/occupant or tenant). Additionally, under certain circumstances, the types of available compensation also varies depending on the length of time that the property has been occupied.
