In Pennsylvania, a person can be convicted of driving under the influence if he or she drives, operates or is in physical control of a vehicle after drinking any amount of alcohol which makes him or her incapable of safely driving a motor vehicle.

Alternatively, a person can also be convicted of DUI for driving, operating or being in physical control of the movement of a vehicle while having a blood alcohol content of .08 percent or higher within two hours of driving that car or other motor vehicle.

Individuals who are being charged with DUI in Pennsylvania oftentimes have options to address the issue.  This is especially true for first time DUI charges.  Nevertheless, filing pre trial motions and/or proceeding to either a bench trial or jury trial are also viable options, especially if there are problems with the police stop, or with the equipment utilized to measure the blood alcohol content.
